What is FSSAI License?

The role & responsibility of FSSAI Dept. is to make sure that all food-related laws are being followed by food business operators. FSSAI Registration or FSSAI License is required irrespective of turnover of the FBO. FSSAI Department reports to Ministry of Health & Family welfare. 

Food License is mandatory for Starting a food business in India. Registration with FSSAI department is mandatory irrespective of the sales turnover of food products. Whether you are a manufacturer or trader or wholesaler or retailer or exporter or importer of food products or supplying raw materials to manufacturer then mandatorily you need to obtain 14 digit FSSAI License or FSSAI Registration Number. As per the Food packaging guidelines, FSSAI Registration Number must be printed on every food packages & License should be displayed on the premises of FBO.

FSSAI has defined a common procedure for all food operators to apply for applicable Food License.

FSSAI Food License has three categories. An FBO can identify the required FSSAI License type basis on its business category & turnover. FSSAI registration online can be done thru Enterslice (Best FSSAI License Consultant in India).

What are the Types of FSSAI License?

  • Who can apply for FSSAI Basic License?

  • For a food Business with turnover below Rs. 12 Lac annually.

    DO will verify the KYC of FBO and if everything is as per law, the application will be approved.

    (Basic License can be obtained in 3 working days)

  • Who should apply for FSSAI State License?

a. For the food Business with turnover between Rs. 12 Lac to Rs. 20 Cr annually. or/additionally,

b. For Manufacturer:

  1. Dairy Units: Production of 501 LPD to 50,000 LPD of milk or 2.5 to 2500 metric tonnes of milk solids per annum.
  2. Vegetable Oil Processing Units: Production up to 2 metric tonnes per day.
  3. All other food Processing Units: All Cereals, grains & pulses milling unit with production between 100 kg/lt to 2 Metric tonnes per day.

(FSSAI State license can be obtained in 30 to 60 days)

c. Other Business (other than manufacturing)

  1. Normal Storage: Capacity up to 50,000 metric tonnes.
  2. Cold Storage: Capacity up to 10,000 metric tonnes.
  3. Atmosphere Controlled Storage: Capacity up to 1,000 metric tonnes.
  4. For Wholesaler: turnover up to 30 crores/annum.
  5. Food Vending Agency: vending machines between 12 to 100 in one States.
  6. Transporter: up to 100 vehicles/turnover up to 30 crores.
  7. Hotel: up to 4 Star hotels.

Note- Respective DO of the FSSAI Department will conduct physical verification of Factory / Warehouse before issuing the State license.

  • Who are all Eligible for FSSAI Central License?

a. For Business with turnover more than Rs. 20 Cr annually. Or/additionally,

b. For Manufacturer:

  1. Dairy Units: Production of more than 50,000 LPD of milk or more than 2500 metric tonnes of milk solids per annum.
  2. Vegetable Oil Processing Units: Production more than 2 metric tonnes per day.
  3. All other food Processing Units: All Cereals, grains & pulses milling unit with production more than 2 Metric tonnes per day.

c. Other Business (other than manufacturing)

d. FSSAI License for Importer / Exporter

Every food business operator intent to export or import food product from/to India, the mandatorily he has to apply for FSSAI Central license before Export or Import will take place in India. FSSAI Central license with help of Enterslice cannot be obtained within 20 to 30 working days.

C. Documents required for FSSAI Central License
For FSSAI Central License

  • Audited balance sheet in case Food Manufacture is applying for a Central license.
  • IEC Code in case FSSAI license is to be applied for Export / Import.

FAQs on FSSAI Registration
1. I import food products in India; Do I need to apply for FSSAI License?

For import of food products in India, You need to apply for IEC (Import export code ) and Apply for FSSAI Central license online before the start of import.

2. Who all require obtaining Food License?

FSSAI License is mandatory for all Food Business Operators including all manufacturer, Re-Packer, trader, retailer, wholesaler, supplier, Transporters, importer & exporter etc.

3. Which type of FSSAI License do I require for 100 % Export outside India?

For Export of product outside India, you need FSSAI Central license. FSSAI Central license can be obtained within 20 working days.

4. Does Start-up also require FSSAI Registration?

Yes, it is legally mandatory for all food business start-up to get FSSAI license/registration to commence their business.

5. What is the difference between State & Central License?

Type of License depends on the nature of the business and its annual turnover/production. An FBO can refer to our above license categorization to identify the correct License.

6. Can a caterer start its business with basic registration certificate?

The registration certificate is not being valid for Caterers. They at least required having State License irrespective of its turnover.

7. Can I operate on multiple stores with one License?

The separate license needs to be issued on each location basis on their annual turnover.

8. What are functional foods product, nutraceuticals, & who is the regulatory authority in India?

The functional food and nutraceuticals product is explained in section 22 of the Act.

9. Does packaged & bottled water come under FSSAI, 2006?

All type of sale of sealed water comes under FSSAI act.

10. Where can I file complain about food bought from a shop or restaurant?

The consumer should file complain to the Food Safety Commissioner of the State. You can reach respective FSSAI office and contact details can be obtained from FSSAI Website.

11. What is the maximum penalty for breach of regulations related to the labeling of food items?

As per FSSAI Act, a penalty up to Rs. 10 lac may be levied.

12. Can I apply for a new license or renew a license online from FSSAI Website?

You can apply for fresh application by via online portal of FSSAI and renewal can also be done online by submitting form C. Except in Delhi and few other states after filing of the online application, you have to submit a copy of application duly signed with an original copy of fees paid to the Department.

13. Whether there will be a single or different license for the same premises having more than one product line like milk, dairy and meat products?

Under FSSAI Act, the compliance for each product has been dined separately keeping in mind of the safety of the community. You would be requiring a separate license for each product category.

14. How to check the status of an application for FSSAI License?

Go on website https://foodlicensing.fssai.gov.in/index.aspx and check it by filling application reference no.

15. Do need to obtain Food license even I am supplying food / Food items to Central Government offices?

Yes. In case you supplying or selling food product at central government offices like Army canteen, Airport, Railway e.t.c then you need to apply for central license irrespective of the turnover of the business.
